Constitutional Rights

                                          DISRESPECT FOR OUR LAW;

     DISRESPECT FOR OUR COUNTRY; DISRESPECT FOR OUR AMERICAN FAMILIES

                    AND CHILDREN; DISRESPECT FOR OUR AMERICAN PEOPLE!

Parents have a constitutional right to be parents to their children.  This principal has been articulated and reaffirmed in case after case.  Why, then, does the SRS have the authority to trump that constitutional right?

In 1972 the Supreme Court spoke.  “The Court stressed, ‘the parent-child relationship is an important interest that undeniably warrants deference and, absent a powerful countervailing interest, protection.’  A constitutionally secured right, given the centrality of family life as the focus for personal meaning and responsibility.”  Stanley v. Illinois, 92 S Ct 1208, (1972). 

How, then, can the SRS undermine the family unit so cavalierly?

In 1982, the U.S. Supreme Court spoke again.  “Even when blood relationships are strained, parents retain vital interest in preventing irretrievable destruction of their family life; if anything, persons faced with forced dissolution of their parental rights have more critical need for procedural protections than do those resisting state intervention into ongoing family affairs.”  Santosky v. Kramer, 102 S Ct 1388, (1982). 

Why, then, can the SRS destroy family life with impunity?

The law says that judges must consider the best interests of the child in making custody decisions in situations where parents are divorcing.  In SRS cases, judges are limited to what the SRS has determined to be the best interest of the child.  We ask you to consider these questions:

Is it in the best interest of a child to have their “responsible adult” to allow them to sneak out at night? 

Is it in the best interest of the child to be sexually assaulted while out of their parents’ care and custody? 

Is it in the best interest of a child to be raped and then not have that child’s parent even notified so that the parent can offer comfort to this hurting, precious child?

If these things are in the best interest of the child, what in the world is not in the best interest of the child?

If it were not so tragic, the answer would make you laugh.  According to the SRS, it is not in the best interest of the child to be raised by his or her parents if the parent is struggling financially.  If the most loving parent is receiving government assistance, it may not be in the best interest of the child for the child to remain in that loving home!

Parents have a constitutional right to parent their own children.   Children should have the right to be raised by the parents who love them.  Laws must change to protect both of these vulnerable groups, parents and children, from the agency that claims to protect them from one another.

                                             PLEASE STAND WITH US, FOR THE CHILDREN.
